1. Agreement
These Terms of Service are an agreement between you and Dialect Agency Inc. DBA Super Simple. By downloading, accessing, or using POE or poeperiod.com, you agree to these terms. Our Privacy Policy explains how information is handled. If you do not agree, do not use the applicable product or service.
You must be at least 13. If you have not reached the age of legal majority where you live, a parent or guardian must agree to these terms on your behalf. You must otherwise be legally capable of entering this agreement.
2. License and use
Our apps are licensed, not sold. Subject to these terms, applicable app-store rules, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the product on supported devices for lawful purposes.
Apps distributed through Apple are also subject to Apple’s Standard Licensed Application End User License Agreement. Other distribution platforms may impose their own mandatory terms. Those platform terms control to the extent they are legally required or directly conflict with these terms.
3. Your device and journal
POE is an offline cycle journal. It requires no POE account or email address, does not connect to Apple Health, and provides no automatic backup or sync. You are responsible for securing your device and reviewing your export and erasure choices. The App Store and operating system are separate services governed by Apple’s terms.
A device passcode must remain enabled. Removing it destroys the keys needed to open the journal. POE cannot recover a forgotten PIN, a lost journal, or erased keys. Optional automatic erasure and the manual kill switch can permanently destroy your journal. Review their scope before enabling or using them.
4. Free to use
POE is being built as a fully free app, with no subscription, trial, advertising or in-app purchase. These terms do not authorize a charge. Your own device, connectivity or Apple service costs remain your responsibility.
5. Your content
Exports are created on your device. Saving or sharing makes a copy controlled by the destination or recipient; POE cannot revoke it. The kill switch cannot remove screenshots, saved/shared exports, previous backups or records already in Apple Health. Review the scope of each deletion action.
You retain your rights in content you create, import, or connect. POE processes your journal locally on your device. These terms do not grant us access to your health data or a right to sell, advertise against or train models on it. You are responsible for your content, its accuracy, lawful use, backups, and the people or accounts with whom you share it.
6. Acceptable use
You may not:
- Use a product unlawfully or to violate another person’s rights.
- Access accounts, devices, systems, or data without authorization.
- Interfere with security, availability, rate limits, or normal operation.
- Introduce malicious code, automate abusive traffic, or attempt to bypass access or payment controls.
- Reverse engineer or redistribute a product except where applicable law expressly permits it.
7. Third-party services
Products may interoperate with app stores, operating systems, hosting providers, payment providers, and other services we do not control. Their terms and privacy practices apply to their services. Changes, outages, or restrictions imposed by a third party may affect product availability or require us to modify an integration. Third-party names and marks belong to their owners and do not imply sponsorship.
8. Ownership and feedback
Super Simple products, software, websites, branding, design, and documentation are owned by Dialect Agency Inc. or its licensors and are protected by intellectual-property laws. No rights are granted except those expressly stated in these terms. If you provide feedback, you permit us to use it without restriction or compensation, while we remain responsible for our own implementation.
9. Changes and availability
App-specific provisions apply when you use POE.
We may update, add, remove, suspend, or discontinue features or products. We aim to communicate material changes when reasonable, but uninterrupted, error-free, or permanently available service is not guaranteed. You are responsible for maintaining appropriate backups of important information.
10. Disclaimers
To the maximum extent permitted by law, products and services are provided “as is” and “as available.” We disclaim warranties not expressly required by law, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. POE is a personal journal, not a medical device or an emergency service. It does not diagnose, treat, prevent or cure a condition. Any dates, patterns or estimates are informational, may be incomplete or inaccurate, and must not be used as contraception or relied on to make fertility, pregnancy or treatment decisions. Consult a qualified clinician about symptoms or medical decisions; do not delay care because of POE.
Nothing in these terms limits warranties or consumer rights that cannot lawfully be excluded.
11. Limitation of liability
To the maximum extent permitted by law, Dialect Agency Inc. and its directors, officers, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, revenue, goodwill, or business opportunity arising from a product or these terms. Our aggregate liability will not exceed the greater of the amount you paid for the applicable product in the 12 months before the event giving rise to the claim or the minimum amount required by applicable law.
12. Indemnity
To the extent permitted by law, you agree to defend and indemnify Dialect Agency Inc. from third-party claims, damages, and reasonable costs arising from your unlawful misuse of a product, violation of these terms, or violation of another person’s rights. This obligation does not apply where prohibited by consumer law.
13. Suspension and termination
You may stop using a product at any time. We may suspend or terminate access when reasonably necessary to address unlawful use, fraud, security threats, material breach or discontinuation. Provisions that by their nature should survive termination will survive, including ownership, disclaimers, liability limits, indemnity, and governing law.
14. Governing law
These terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, except where the law of your residence or another mandatory consumer law applies. Subject to those mandatory rights, disputes may be brought in the state or federal courts with jurisdiction in Albany County, New York. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
15. Changes to these terms
We may update these terms to reflect product, business, or legal changes. We will post the updated terms and revise the effective date. We will provide additional notice or request consent when required by law.
